Portable Therapeutix, LLC is the owner of this Website and of Squid Go, including all patents and trademarks relating to the Squid cold compression system. All content on this Website, including text, images, graphics, logos, and product descriptions, is owned by or licensed to Portable Therapeutix and is protected by copyright and trademark law. You may not use, copy, reproduce, or distribute any content from this Website without our express written consent.
2. MEDICAL AND SAFETY NOTICE
Squid is a cold compression product intended for personal use. Before purchasing or using Squid, you should review the information on who should not use Squid, found in the Support section of this Website and in our Instructions for Use (IFU) manual. This information describes the contraindications for the product. Portable Therapeutix is not responsible for verifying whether a purchaser has any condition that would prevent them from safely using Squid. It is the responsibility of the purchaser to understand whether they, or the person for whom they are purchasing, should not use Squid. Always consult your doctor before using Squid, particularly for post-surgery recovery. This Website does not provide medical advice and is not a substitute for the guidance of a qualified healthcare provider.
3. USE OF THE WEBSITE
We may modify the content of this Website at any time. We may also update these Terms from time to time, and any change is effective when posted on the Website. Your continued use of the Website after a change is posted means you accept the updated Terms, so please review them regularly.
4. PRODUCTS, PRICING, AND PAYMENT
All products must be paid for in full before they ship. Payment includes shipping and handling and any applicable sales tax. Your payment method is charged when you place your order. If a pricing error appears on the Website and you are charged less than the correct price, the difference is in your favor and we will refund it in the same manner you paid. If an error is not in your favor, we will contact you before shipping to confirm you still want the product and to authorize the corrected amount. If an item is unavailable, we will notify you and it may be placed on back order.
5. SHIPPING AND DELIVERY
Squid Go is currently for sale only in the United States and its territories. Any order with a shipping address outside those areas will be cancelled. Orders generally ship the next business day unless an item is on back order. If part of your order is back ordered, we will contact you to confirm whether to hold the full order or ship it in parts.
6. INSPECTION AND SHIPPING DAMAGE
You must report any physical damage caused by shipping within two (2) business days of receiving your product. If you do not report damage within that time, you are deemed to have accepted the product in the condition received and the sale is final. If your product arrives damaged, contact Customer Support to request a Return Authorization Number; we will cover freight on authorized shipping-damage returns. 7. RETURNS

If either party cannot perform on time due to circumstances beyond its control, including acts of God, fire, flood, earthquake, tornado, hurricane, or acts of war or terrorism, the time to perform will be extended as necessary.
14. GOVERNING LAW AND JURISDICTION
These Terms and any purchase made through the Website are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Jurisdiction and venue lie in the state courts of Harris County, Texas, or the United States Federal Court for the Southern District of Texas in Harris County.
15. LIMITATION ON CLAIMS
Any claim or cause of action arising out of or related to the Website or these Terms must be filed within one (1) year after it arose, or it is permanently barred, regardless of any law to the contrary.
16. SEVERABILITY AND WAIVER
Our failure to enforce any provision of these Terms is not a waiver of it. If any provision is found invalid, the remaining provisions stay in full force, and the invalid provision will be interpreted to give effect to its intent as closely as the law allows.
